How long is a special education referral good for? or is it a one time process?

Jade Ohno: You need a new evaluation. If a student was evaluated and did not qualify - this is a NEW evaluation. It is important when doing a Special Education Evaluation that folks look comprehensively not just what they 'think' might be there.

Lindsey Zanardi: If a student is found "not eligible" for special education services, an additional referral would be required for future evaluations. This is because the next evaluation would also be considered an initial evaluation, and all procedures followed during the first evaluation would have to followed on the subsequent evaluation. Upon receipt of a referral for evaluation (either from a parent or teacher), the school has 30 days to determine if they suspect a disability. This is generally done by reviewing the student's records, previous testing, behavior patterns, attendance record, response to interventions, etc. If a disability is not suspected, the team may develop classroom interventions that focus on t! he area of need. If a disability is suspected, prior written notice is then given to the parent informing them of their intention to move forward with an evaluation, and consent for testing is signed. The school district then has 60 calendar days from the date of consent to complete the evaluation and hold the evaluation team report meeting. A determination will then be made at this meeting as to whether or not the student qualifies for special education services as a child with a disability....Show more

Melvina Bieri: in public schools in the US. a student has to be tested within 30 days of a parents written request.if you've already been found ineligible for service, then you need to request again stating its for a different criteria. However. the school may or may not find your child eligible.my son was found ineligible for speach language services before school.. however once he was in kindergarten he suddenly became priority for them.. but the principal re! fused to test him for other issues, both myself and the teache! r were concearned over. Basil Blasingame: A child must be tested within sixty days when referred...Has this child been through SST (student support team)? Usually students go through this process before a referral is even requested to see if the there is a true concern or if classroom strategies/modifications adequately help the child. I imagine a new referral would need to be made stating the reason why a new evaluation is warranted. It would be helpful to know what the original reason for referral was and why the student was ineligibile, and what disability do you think the child has now. If a full psychological was done in the past, that information *probably* has not changed much and would have picked up on many disorders....Show more

Morris Cuomo: No the referral is not good forever. There are certain time-lines that must be met for the good of the child and to kee! p people on their toes! A new referral would need to be done but the previous testing could, I think, still be considered. To my understanding a referral is not just to check for one disability, it should be screening for any disability that is effecting the student's learning. As long as a complete psychological evaluation was done it should have included an IQ test of some sort and achievement testing that would see if the child is achieving at their age or grade level. Of course for younger children it is more developmental in nature such as have they reached certain milestones in each area. If you are the parent and you feel that the evaluations that were done the first time were not complete enough and maybe didn't pick up on what your child's learning problems are, then I would think you have due process rights to request another referral and more testing. Just be vocal at the meeting and request the type of evaluation you want. Now if the school doesn't have ! someone to complete this or refuses to pay extra for it your quickest o! ption would be to get the eval done on your own and take a copy into the school. Good luck! You also could consider a 504 plan for your child - this is not as comprehensive as an IEP but it allows for certain special accomodations and modifications that your child may need. You have to have documentation from a doctor or evaluator to get one, but if you have that it is easier to get than special education services....Show more
